No Punishment for the Death of Jang Ja-yeon

A Justice Ministry committee on past cases handled by the Prosecution Service acknowledged the truth of some notes by Jang Ja-yeon, which recorded the fact that she was forced to drink and entertain the son of a Chosun Ilbo president, but concluded that they lacked the requirements of a criminal offense.

The committee did not recommend another investigation on grounds of the statute of limitations and lack of evidence. It will no longer be possible to criminally punish the person responsible for the death of Jang.

On May 20, the committee announced eight findings from their investigation of Kim Jong-seung, the president of Jang’s management company who allegedly forced the actress to have drinks with and entertain men; the alleged sexual services for Bang, the president of Chosun Ilbo, and the newspaper company's attempt to discourage an investigation; and the insufficient investigation by the police and prosecutors.

The committee believed that Jang Ja-yeon's notes on how Kim assaulted and threatened her and on how she was forced to drink with and entertain the son of a Chosun Ilbo president "were mostly consistent with fact, despite some exaggeration." However, they said that it was difficult to verify “Jang Ja-yeon's list,” which recorded the names of the male perpetrators.

As for the investigation of Bang, the president of Chosun Ilbo, the committee said, "The authorities did not conduct an investigation to identify Bang or to verify any record of Jang having complained about the injuries she suffered. This was poorly handled by the investigators."

As for the allegations that the people from the Chosun Ilbo exerted pressure to discourage the investigation, the committee said, "We confirmed that the Chosun Ilbo threatened Cho Hyun-oh, head of the Gyeonggi Provincial Police Agency."

The committee confirmed circumstantial evidence of key allegations, such as forced prostitution and an insufficient investigation, but was unable to recommend another investigation due to the statute of limitations. As for the alleged rage of Jang, the committee said, "The authorities are likely to uncover the truth in an additional investigation, but the statute of limitations for rape and indecent assault has already expired. The statute of limitations for special rape has yet to expire, but the facts and evidence have not been sufficiently verified to immediately launch an investigation."

The committee only advised an investigation of the alleged perjury by Kim in the libel case concerning lawmaker Lee Jong-kul. The committee recommended the Prosecution Service to preserve records in case evidence of rape is discovered after the victim's death, and to enact legislation on legal distortion for actions to conceal evidence by an official in an investigative agency. This day, the Chosun Ilbo responded to the committee's announcement by stating plans to take legal action and said, "It was only based on unilateral arguments of some figures and is not true at all."
